• Company: NYLYN Solar e.U., which offers sustainable energy products and services to end consumers.
• Customer: Any natural or legal person who enters into a contract with the Company.

§ 2 Scope of Application

These General Terms and Conditions apply to all contracts between NYLYN Solar e.U., Ferrogasse 26, Nr 5, 1180 Vienna, Austria, and the Customer.

§ 3 Contract Conclusion

1. The presentation of goods on the website constitutes an offer.
2. The Customer places an order, expressing their intent to purchase.
3. NYLYN Solar confirms the order, signifying acceptance and forming the binding contract.

§ 4 Delivery Terms / Delivery Costs

1. Free shipping for orders over €500.
2. Otherwise, standard delivery costs apply.

§ 5 Payment Terms

1. Payment methods: Visa, Mastercard, PayPal, ApplePay, Google Pay, Shop Pay, Bankcontact, Klarna Pay Now, Klarna Pay Later, eps transfer, iDEAL.

§ 6 Retention of Title

The goods remain the property of NYLYN Solar e.U. until full payment is received.

§ 7 Warranty

1. The warranty varies depending on the product. Details are provided at the time of purchase.

§ 8 Cancellation Policy

1. Right of withdrawal within 14 days. The Customer bears the return shipping costs and a processing fee of 10%.
2. No right of withdrawal for clearance items.

§ 9 Limitation of Liability

1. Liability is limited to intentional or grossly negligent behavior.

§ 10 Information on Online Dispute Resolution

Reference to the EU platform for online dispute resolution.

§ 11 Final Provisions

1. Austrian law applies.
2. The court in Vienna has jurisdiction for disputes.

§ 12 Value Added Tax (VAT)

1. Prices: The prices listed on our website are inclusive of statutory VAT.

2. 0% VAT for Photovoltaic Systems:

• By purchasing a product on our website marked as eligible for the 0% VAT rate on photovoltaic systems in Austria, you acknowledge and agree to the following:
  • The purchased photovoltaic system has a maximum output of 35 kW.
  • The system will be installed in a residential building (single-family home, multi-family residence, or residential part of a mixed-use building).
  • The installation will be completed before January 1, 2026.
• Customers are solely responsible for ensuring that their purchase meets the eligibility criteria for the 0% VAT rate. NYLYN Solar is not liable for any potential VAT charges imposed if these criteria are not met.
